How the penalty works
A violation is a misdemeanor and each violation is a separate offense (Sec. 4-1-10(g)). No specific amount is set, so the general penalty applies: Sec. 1-6-1, a fine not exceeding $1,000.00 or imprisonment not exceeding 60 days, or both. Sec. 1-6-1 was read on Municode, which for Augusta is codified only through Ord. No. 7807 (December 7, 2021), so a later amendment to Sec. 1-6-1 would not appear there. The dog park rule in Sec. 4-1-31(f) of the 2025 text also points to Sec. 1-6-1.
The carry rule
Sec. 4-1-10(f) requires immediate removal only. The dog park rules (Sec. 4-1-31) require handlers to carry a leash, not bags.
Service animals
No guide or service dog exemption in Sec. 4-1-10(f) of the 2025 text or in the older Sec. 4-1-13(f).
In practice
Pick up every time, bag it, and put it in a trash can. That is the one method that satisfies every ordinance in the country. The Walk Dispenser clips to the leash and holds a full roll.
