How the penalty works
On conviction, 6.08.350 requires a fine of not less than $100 for a first offense, $200 for a second and $300 for a third or later, within a maximum of $500 and/or up to three months in jail.
The carry rule
No carry requirement. The person with custody of the dog must dispose of feces in a sanitary manner and may not leave it on public property or another person's private property except in approved containers or with the owner's consent. The only exemption is for law enforcement officers using the dog for law enforcement or rescue. 6.08.150 separately requires owners to remove dog waste from their own yard at least once every five days.

In practice
