How the penalty works
Range of $10 to $500 per conviction (§ 6:1-12e: 'fined in a sum of not more than $500, nor less than $10'). The code does not publish a separate repeat-offense amount. Enforced by the Department of Public Works, the Newark Division of Police, or the Department of Health and Community Wellness (§ 6:1-12d).
The carry rule
No requirement to carry a bag. The ordinance requires immediate removal and disposal in a designated waste receptacle or other suitable non-leaking container, or into the sanitary sewer (§ 6:1-12a, b).
Service animals
§ 6:1-12c: an owner or keeper who requires the use of a disability assistance animal is exempt while the animal is being used for that purpose.
In practice
