How the penalty works
Civil infraction under Sec. 6-45(b), with amounts set by Sec. 6-71(b): first violation $100 if contested and upheld or $50 if not contested; second violation $300 contested or $200 uncontested; third and each later violation $500 contested or $400 uncontested. Violations are counted within a one-year period. Failure to pay or appear allows a judgment of up to $500. Miami-Dade County Code Chapter 5 applies in incorporated areas too (Sec. 5-2(a)), so County Sec. 5-20(c) also binds dog owners in the City of Miami: the county civil penalty listed in Sec. 8CC-10 for 5-20(c) is $50, and Sec. 5-20(g) sets a second violation at 2.5 times, a third at 3 times and later violations at 3.5 times that amount (which works out to $125, $150 and $175), plus a $5 surcharge under Sec. 5-2(f). The county can also prosecute in County Court for a fine of up to $500 or up to 60 days in jail (Sec. 5-2(e)).
The carry rule
Sec. 6-45(a) says fecal matter shall be immediately removed by placing it in a closed or sealed container, but neither Sec. 6-45 nor County Sec. 5-20 requires carrying bags in advance.
Service animals
City Sec. 6-45(a) exempts only blind persons accompanied by a dog used for their assistance. County Sec. 5-20(f) is broader: subsections (b) through (d), including the pickup rule in (c), do not apply to a person using a service animal (Sec. 5-1 defines service animal by reference to the ADA).

In practice
